Cindy Mitchell represents business clients in federal and state courts. Her civil litigation practice focuses on complex litigation in federal and state courts and has represented clients in a wide variety of cases. Her practice emphasizes complex commercial litigation, class action defense, intellectual property, business torts and contracts, and other corporate litigation.
Cindy is an experienced class action litigator. She has successfully defended class action lawsuits in both federal and state courts. She also is experienced in the early resolution of class actions, including structuring favorable settlements. Cindy’s practice also includes representation of companies and their officers and directors in complex proceedings involving corporate and business disputes, breach of contract, and allegations of securities fraud. Cindy has represented insurance carriers in matters involving breach of contract and bad faith.
Representative Matters
Though past cases are not predictive, Cindy’s experience includes:
• Defended an insurance carrier in a putative class actions regarding the sale of uninsured motorist coverage and other automotive coverage in the States of Colorado, Pennsylvania, Montana and Alabama
• Represented an insurance carrier in a putative class action involving homeowner’s insurance securing a dismissal in the U.S. District Court for the District of Colorado
• Secured a recovery for Ponzi-scheme victims in securities class action
• Obtained reversal by Tenth Circuit in case concerning requirements for removal under the Class Action Fairness Act

• Represented an insurance carrier in a federal class action suit regarding the sale of personal injury protection in connection with automobile insurance — summary judgment granted and motion for class certification dismissed as moot. U.S. Court of Appeals, Tenth Circuit, affirmed.
• Represented health care insurer in a federal class action suit regarding claims related to the provision of certain mental health benefits.
• Represented multi-national banking institution against breach of contract and tort claims brought by hedge fund.
• Represented numerous corporate officers in action for breach of fiduciary duties and fraud — motion to dismiss granted.
• Represented a broker-dealer in a NASD investigation regarding noncash compensation received from product vendors.
• Represented managers and representatives of a large broker-dealer in a NASD investigation regarding suitability of mutual fund Class B share recommendations.
• Matters handled prior to joining SGS.
